Rear-End Collision Basics

November 20, 2015

Did you know that rear-end collisions are the most common type of motor vehicle accident ? Most people assume that rear-end accidents, or “fender benders,” aren’t serious, but they can actually be quite significant. Here’s what you need to know about rear-end collisions and what to do if you or a loved one were involved in a crash.

Injuries Are Common With Rear-End Collisions

Injuries can occur in seemingly minor rear-end car accidents, the most common being whiplash. Whiplash occurs when the muscles and ligaments of the neck are suddenly stretched and overextended, or “whipped,” around by the force of the crash. Whiplash can cause neck and shoulder pain, back pain, dizziness, vision problems, a decreased range of motion, and more.

Who Is At Fault for a Rear-End Collision?

Most people think that fault is automatically assigned to the person who rear-ended the vehicle in front of them. However, this is not necessarily true. There are numerous factors that must be evaluated in any auto accident to determine who is at fault. While it’s true that the person who rear-ended the other will most likely be held responsible for the crash, the person who was rear-ended may also have contributed to the accident.

Rear-End Collisions Are Often Settled

Because rear-end accidents are often simpler than other types of car crashes, they are usually settled out of court. The insurance company may make a reasonable offer to cover property damages and injury costs, and the case may never see the inside of a courtroom. In some cases, rear-end collisions need to be litigated in the event that the insurance company does not offer an adequate settlement or additional damages need to be pursued.
